Being a US-based entity with a minimum of one year of operational history and a valid Employment Identification Number.

Ensure valid Worker’s Compensation Insurance or equivalent coverage for all FUSIA-sponsored interns/trainees, paid or unpaid, unless exempt by state law (e.g., Texas).

No pending legal issues, disputes, or activities that could compromise program integrity, participant well-being, safety, or harm the reputation of the Exchange Visitor Program or the Department.

The program cannot be used for regular employment, must not displace American workers, and offered positions should not be advertised as regular jobs.

Ensure the site is conducive to training in a professional setting, with necessary resources, equipment, skilled onsite personnel, and continuous on-site supervision to facilitate the training.

Positions are on-site, full-time (32+ hours/week), and comply with FLSA regulations. Salaried roles must meet federal and local wage laws (W-4 required; 1099/commission-based not allowed). Unpaid or stipend roles must follow DOL's FLSA seven-point test and local requirements.

Maintaining a balance between intern learning opportunities and their contributions to the organizations where they are placed.

Allowing participants to obtain skills, knowledge, and competencies through structured activities like classroom training, seminars, department rotations, on-the-job training, and conference attendance.
